Welcome to Digital&Story. These Terms and Conditions (“Terms”) govern your use of our website https://digitalandstory.com (the “Site”) and the services we offer. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Introduction
By engaging with Digital and Story Web-design DWC-LLC, whether through subscription plans or project-based services, you (“the Client”) agree to the following Terms & Conditions. These terms govern the provision of web design, digital marketing, and related services offered through our subscription plans (Starter, Growth, Pro) as well as one-time project-based engagements.
2. Scope of Services
Digital & Story provides professional web design updates, full website projects, digital marketing services including social media content creation, Meta and Google Ads setup or management (depending on plan or project agreement), email campaigns, SEO optimization, and analytics setup using Google Analytics and Google Search Console.
Subscription Services: The scope of services is defined per plan, and any requests outside the plan’s agreed scope may incur additional charges.
Project-Based Services: The scope of work will be defined in a separate project proposal or agreement, including deliverables, timeline, and costs. Any changes outside the agreed project scope may result in additional fees.
Excluded from all services are hosting costs, domain registration, third-party software, ad spend, and large-scale redesigns beyond the agreed scope.
3. Payment Terms
Subscription Services: Fees are billed monthly in advance. Payment must be received before work commences. Accepted payment methods include credit/debit cards, PayPal, and bank transfer.
Project-Based Services: Fees are billed according to the project agreement. A deposit may be required before work begins, with the remaining balance payable upon milestone completion or project delivery.
By engaging our services, you authorize Digital & Story to charge your selected payment method automatically for subscription services or as agreed for projects. Late payments may incur a 5% late fee. No refunds are provided for partial months or unused services unless specified in the project agreement.
4. Subscription & Cancellation
Subscription Services: Minimum commitment for Starter and Growth plans is three months. Pro plan operates on a month-to-month basis with 30 days’ notice required for cancellation. Cancellation requests must be submitted in writing via email.
Project-Based Services: Once a project agreement is signed and work has commenced, cancellation may be subject to a cancellation fee, calculated based on work completed to date.
Digital & Story reserves the right to suspend or terminate services for non-payment or breach of these terms.
5. Client Responsibilities
Clients are responsible for providing timely access to all necessary platforms, accounts, and content required to execute services effectively. This includes providing clear requests, assets, and approvals within a reasonable timeframe. Delays caused by the client may impact turnaround times.
For subscriptions, active requests are limited per plan. Additional requests will be queued. For projects, clients are expected to respond and provide materials in accordance with the project timeline to avoid delays.
6. Intellectual Property
All original content provided by the client remains the client’s property. Digital & Story retains ownership of all designs, templates, and intellectual property until full payment is received. Upon full payment, rights to deliverables are transferred to the client unless otherwise agreed in writing.
For project-based services, ownership and licensing terms will be outlined in the project agreement.
7. Confidentiality
Both parties agree to maintain confidentiality of non-public information shared during the engagement, including business strategy, login credentials, campaign performance data, and other proprietary information.
8. Limitation of Liability
Digital & Story shall not be held liable for any indirect, incidental, or consequential damages arising from the use of its services, including but not limited to lost revenue, lost profits, or data loss. The total liability shall not exceed the fees paid for subscription services in the last three months or the total project fees paid for project-based services.
Services may be affected by factors beyond our control, including internet outages, platform downtime, or other force majeure events, and we are not responsible for delays caused by such circumstances.
9. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates, and any disputes shall be subject to the jurisdiction of Dubai courts.
10. Agreement
By subscribing to a plan or engaging Digital & Story for a project, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.
11. Changes to Terms
We may update these Terms at any time. Changes will be posted on this page with a revised effective date. By continuing to use the Site, you accept the revised Terms.
